Open Internet Transparency Statement

The Federal Communications Commission ("FCC") requires broadband internet access providers to publicly disclose accurate information about the network management practices, performance characteristics, and commercial terms of their broadband services. This statement provides those disclosures for Meter's Connect Services.

This statement supplements, and does not replace, Meter's Master Services Agreement, Acceptable Use Policy, and Privacy Policy. Capitalized terms not defined here have the meanings given in the Master Services Agreement.

1. Network Management Practices

1.1
Blocking. Meter does not block lawful content, applications, services, or non-harmful devices, except as part of reasonable network management or as required by law. Meter and its underlying ISPs may block traffic that violates the Acceptable Use Policy, presents a security risk, or is unlawful.

Throttling. Meter does not throttle, degrade, or impair lawful internet traffic based on content, application, service, user, or use of a non-harmful device, except as part of reasonable network management.
1.3
Affiliated and Paid Prioritization. Meter does not engage in paid prioritization. Meter does not favor traffic from any affiliate or third party in exchange for consideration.
1.4
Congestion Management. Meter and its underlying ISPs use commercially reasonable network management practices to mitigate congestion and protect service quality for all customers. These practices may include identifying sources of excessive traffic and applying traffic-shaping measures during periods of congestion. Meter applies these practices in a content-neutral manner.

Application-Specific Behavior. Meter does not block, throttle, or modify specific applications, protocols, or protocol ports except (a) as required to protect the network or customers from security threats, (b) to comply with law, or (c) to enforce the Acceptable Use Policy.

Device Attachment. Customer may attach any non-harmful device to the Connect Services, provided the device complies with applicable technical standards and does not impair the network or other customers. Certain Connect Services may require the use of specific equipment, as set forth in the applicable Order.

Security. Meter and its underlying ISPs use a range of tools and techniques to protect network and customer security, including monitoring for unusual activity, blocking known malicious sources, mitigating denial-of-service attacks, and suspending or terminating accounts associated with malicious activity. Meter does not publish the specific details of these tools and techniques in order to preserve their effectiveness.

Specialized Services. Meter does not currently offer specialized services (non-broadband data services delivered over the same last-mile infrastructure as the Connect Services). If Meter offers specialized services in the future, Meter will update this statement to describe how those services may affect the last-mile capacity available for, and the performance of, the Connect Services.

2. Performance Characteristics

Meter delivers the Connect Services through agreements with third-party internet service providers using a range of technologies, which may include dedicated internet access (DIA), broadband internet, fixed wireless, ethernet transport, and other access methods specified in the applicable Order.

Bandwidth, port speed, and latency for any given Circuit depend on the underlying technology, the underlying ISP, the Designated Location, network conditions, and Customer's equipment. Specific performance commitments, if any, are set forth in the applicable Order or service level agreement.

The Connect Services are suitable for typical business internet uses, including web browsing, email, video conferencing, file transfer, cloud applications, and voice over IP. Meter does not guarantee uninterrupted service. Disruptions may result from power outages, equipment malfunctions, Customer-caused issues, underlying ISP issues, or other causes outside Meter's control.

The Connect Services are not intended for use as a primary emergency service or life-line telecommunications service.

3. Commercial Terms

3.1
Pricing. Pricing for the Connect Services is set forth in the applicable Order. Customer is responsible for all applicable taxes, regulatory fees, surcharges, and pass-through costs, as set forth in the Master Services Agreement.
3.2
Payment. Payment terms are set forth in the applicable Order.
3.3
Privacy. Meter's collection, use, and disclosure of information in connection with the Connect Services is governed by Meter's Privacy Policy.
3.4
Redress. To report a service issue, a billing dispute, or any other concern relating to the Connect Services, contact Meter at support@meter.com. Meter will use commercially reasonable efforts to address inquiries promptly.

4. Additional Disclaimers

Nothing in this statement is intended to limit Meter's or any underlying ISP's ability to take reasonable measures to address copyright infringement or other unlawful transfers of content in response to information provided by rights holders, in cooperation with law enforcement, or otherwise as permitted by applicable law.

Meter and its underlying ISPs reserve the right to cooperate with law enforcement and other government authorities in response to lawful subpoenas, court orders, and other compulsory legal process.

5. FCC Complaints

A customer who believes that the terms of this statement are not being met may file a complaint with the FCC. Information on filing a complaint is available at consumercomplaints.fcc.gov.

6. Updates

Meter may update this statement from time to time by posting a new version on its website. Updates take effect upon posting.
